These subjects are extremely important to discuss because there are many ways to protect a work. That decision should not be made as a consequence of the work being infringed but should be strategic and fit together with the vision of the work and how it will be used and commercialized.
Copyright protection generally occurs at the time a work is created however there are certain works that are atypical or which may better protected using another form of intellectual property.
Patent protection (in the US) is used to cover both designs and useful articles. Fashion designers have obtained patents to protect the appearance of fabric, dresses or garments, and bags, eyeglass frames and shoes. For example, Gucci was granted a design patent for its signature GG fabric design and Burberry a utility patent for its trench coat construction.
Trademark protection is widely used in the fashion industry to protect certain components of articles of clothing and accessories. For example the Louis Vuitton insignia and Chanel interlocking CC buttons.
Understanding the underlying international treaties and agreements governing the protection of intellectual property rights and electronic commerce becomes a necessity when judging where an infringement has occurred and where is the correct and, in cases where more than one location exists, most advantageous jurisdiction to bring suit.
